Italy: Ticino Moves to Ban Disposable Vapes Ahead of Federal Law

The State Council of Ticino has approved a motion to prohibit the sale of single-use disposable e-cigarettes across the canton. Health and Social Affairs Director Raffaele De Rosa presented the initiative following a parliamentary motion by Centre Party MP Maddalena Ermotti-Lepori, with implementation expected as early as summer 2026.

Targeting Youth Nicotine Use and Electronic Waste

Flavored single-use vapes have spread rapidly among youth, prompting dual concerns over nicotine dependence and hazardous waste. Because these devices integrate non-removable lithium batteries, plastic casings, and chemical residues, they are typically discarded in general waste rather than recycled, creating persistent environmental hazards.

Federal Court Decision Clears the Path for Cantonal Bans

Ticino’s legislative push follows a ruling from the Federal Supreme Court in Lausanne regarding the Canton of Valais, which banned disposable vapes in May 2025. In July, federal judges dismissed legal challenges from retailers, establishing that cantonal sales bans comply with federal law and serve legitimate public interests.

Other cantons, including Geneva and Jura, have advanced similar restrictions. While the Federal Assembly passed a motion in June 2025 directing the Federal Council to draft a nationwide ban, Swiss law allows cantons to enact their own bans immediately.

Under the proposed Ticino law, the sales ban applies strictly to single-use disposable vapes. Standard rechargeable vaping hardware and refillable e-liquids will remain legally accessible to adult consumers.
