NC: Kinston Proposes Strict Zoning and Distance Rules for Vape Shops
The Kinston City Council is set to review strict new zoning regulations for tobacco, vape, and CBD shops on May 19. This legislative push follows a massive police raid on local shops that seized illegal substances and millions in cash, prompting city officials to prioritize public safety and orderly development.
Currently, more than 20 such establishments operate within the city limits and its extraterritorial jurisdiction. Planning staff noted that the proposed text amendment aims to balance commercial business needs with the city’s responsibility to protect the health and welfare of minors.
Under the draft ordinance, vape, hemp, and CBD retailers would only be permitted in General Business (B-1) and I-B districts, and only after securing a special use permit.
To limit shop density and proximity to vulnerable populations, the proposal introduces aggressive separation requirements:
- Residential Areas:Â Banned within 500 feet of any residential zoning district.
- Community Spaces:Â Banned within 2,000 feet of schools, daycares, parks, religious institutions, and youth facilities.
- Business Density:Â Banned within 2,000 feet of another tobacco, vape, hemp, or CBD establishment.
Additionally, the rules mandate exterior visibility standards. Retailers must ensure that street-level windows remain unobstructed, allowing clear views of the interior from the public right of way.
Existing legal businesses will not be forced to close. The proposed ordinance allows current shops to continue operating, expanding, or renovating under the city’s Unified Development Ordinance nonconformity rules. If approved by the council, the new zoning regulations will take effect immediately.
