Reading Vape Shops Face New Fines Under 2026 Tobacco Act
Trading Standards officers in Reading have secured expanded statutory powers to penalize retailers who supply vapes and nicotine products to minors. Enacted under the Tobacco and Vapes Act 2026, the updated regulations target underage sales, proxy purchasing, and unregulated promotional distribution across the borough.
Key Restrictions for Retailers and Distributors
The updated legal framework introduces strict operational rules for retail shops, event organizers, and marketing campaigns:
- Proxy Sales Prohibited: It is illegal for adults to purchase nicotine or vaping goods on behalf of individuals under 18.
- Mandatory Challenge 25: Retailers must consistently check identification for all nicotine vapes, zero-nicotine devices, nicotine pouches, and related consumables.
- Vending Machine Ban: Selling vape or nicotine items through automated vending machines is prohibited.
- Free Sample Prohibition: Distributing free nicotine or vape samples at events, retail counters, or promotional campaigns is banned.
Enforcement and Fixed Penalty Notices
To enforce compliance, Trading Standards officers can issue immediate Fixed Penalty Notices (FPNs) for display breaches, underage sales, and illicit distribution. Retailers face fines of £200, which are reduced to £100 if paid within 14 days. Failure to settle an FPN can lead to formal criminal prosecution in court.
Local officials emphasized that the measures aim to protect public health while holding irresponsible traders accountable.
“This is a welcome step forward in protecting young people from the harms of smoking and nicotine addiction,” stated Cllr Rachel Eden, Lead Councillor for Education and Public Health at Reading Borough Council. “Reading fully supports the ambition to create a smoke-free generation, and this legislation will strengthen the successful work already undertaken to tackle illegal sales.”
Cllr Finn McGoldrick, Lead Member for Environmental Services and Community Safety, added: “Most businesses in Reading comply with the law, but where children and young people are put at risk, we now have stronger tools to act. These new powers will help us protect young people and support responsible retailers.”
