Argentina: Río Negro Advances Indoor Vaping Ban in Public Spaces
The Legislature of Río Negro Province, Argentina, has approved in the first round a modification to Provincial Law No. 4714, aiming to update tobacco control regulations. The key change explicitly incorporates a prohibition on the use of electronic cigarettes, vapes, and electronic nicotine delivery systems (ENDS) in all enclosed spaces accessible to the public.
The initiative, authored by legislator Javier Acevedo (CC-ARI bloc), addresses the “exponential growth” of vaping, particularly among adolescents and young adults. Acevedo emphasized the need to adapt laws to new consumption realities to protect public health from proven harms. “Prohibiting the use of these devices is not persecuting anyone, it is acting with responsibility and common sense,” he stated.
The updated legislation defines vaping and extends the scope of Law 4714 to include ENDS—whether they contain nicotine or not—applying the same restrictions currently in place for traditional tobacco. Furthermore, it mandates the provincial state, through the Ministry of Education, to implement awareness campaigns about the harmful effects of vaping, specifically targeting youth, educational communities, and families to promote 100% smoke-free and aerosol-free environments. The bill aligns with warnings from health organizations like the WHO and PAHO regarding the toxic substances found in vape aerosols.
