New Jersey: Sea Bright Bans Vape Shops & THC Sales
The Sea Bright Borough Council has adopted a new ordinance prohibiting the operation of tobacco establishments, vape shops, and the sale of THC products within the town’s boundaries. The measure, which took effect immediately upon its adoption on August 19th, aims to promote public health and safety by restricting businesses primarily associated with tobacco and vaping.
“This ordinance reflects our community’s commitment to protecting public health and preserving the character of our small beach town,” said Mayor Brian Kelley. The ordinance amends the borough’s land use code to add these businesses to the list of prohibited uses.
A “tobacco establishment” is defined as a business where at least 51% of retail sales come from tobacco products, while a “vape shop” is a premises primarily dedicated to selling electronic smoking devices and vapor products. Michael Balka, health officer for the Jersey Shore Regional Health Commission (JSRHC), praised the ban as a “proactive step toward protecting public health – especially among youth and vulnerable populations.” He noted it builds on the commission’s previous efforts to license and regulate e-cigarette retailers.
Sea Bright’s action aligns with a growing trend in Monmouth County. Middletown Township banned the opening of new vape shops in 2023, and the Borough of Shrewsbury has prohibited shops primarily engaged in the retail of electronic smoking devices since 2012.
