South Africa Advances Tobacco Bill to Restrict Public Vaping and Smoking
The South African Parliament has advanced the Tobacco Products and Electronic Delivery Systems Control Bill to clause-by-clause deliberations. This legislative step, approved by the Portfolio Committee on Health, brings the country closer to enforcing a ban on public vaping and smoking.
The committee voted 10 to one in favor of the bill’s desirability, following public consultations that gathered nearly 7,900 public hearing attendees and about 40,000 written submissions.
Parliament Debates Public Smoking and Vaping Bans
Under the current draft, the law would mandate 100% smoke-free indoor public spaces and specific outdoor zones. It also introduces plain packaging with graphic warnings and bans the display of tobacco and electronic delivery systems at checkout counters.
Additionally, advertising, sponsorship, promotion, and vending-machine sales would face prohibitions under the new rules, changing how these products are marketed and sold.
Lawmakers Consider Harm Reduction and Product Differentiation
A key point of debate during the deliberations is the regulatory distinction between combustible tobacco and non-combustible nicotine alternatives.
Members of Parliament noted that products that burn tobacco present different health risks compared to electronic delivery systems. The committee now intends to address harm reduction by differentiating how these products are regulated under the final law.
Addressing the Illicit Tobacco Market
The committee is also addressing South Africa’s large illicit cigarette market. To strengthen enforcement, lawmakers want the country to ratify the international Protocol to Eliminate Illicit Trade in Tobacco Products.
The bill must still clear the remaining parliamentary stages and receive presidential assent before the new rules take effect.
