The legislative ban on selling flavored e-cigarette additives, introduced by the Verkhovna Rada on July 11, 2024, has failed to materialize on the streets. Mykhailo Poliakov, deputy general director for corporate affairs at Philip Morris Ukraine, stated that the legislation is virtually useless without local compliance monitoring.
“In Kyiv, 9 out of 10 shopping centers have illegal vape shops,” Poliakov noted during a recent European integration dialogue. He publicly questioned whether law enforcement and regulatory authorities are simply ignoring these widespread violations, which are actively harming legal, tax-paying competition.
How the Black Market Bypasses Tobacco Laws
The illicit tobacco and vape market has developed sophisticated methods to circumvent existing laws. While the government installed tax posts and video surveillance at legal tobacco factories, illicit operators simply opened unregulated workshops just kilometers away to avoid detection.
Furthermore, black-market sellers are actively backdating product packaging. By stamping old production years on new packs, they bypass current minimum price regulations—a critical evasion tactic given that taxes now account for more than 70% of a legal product’s price.
Expert Verdict: The Need for International Pressure
The Ukrainian legislative framework is currently functioning as a penalty for compliant businesses while offering a free pass to the black market. Passing bans without the operational force to police them only fuels organized crime. Industry leaders are now looking to international partners, such as the IMF, to pressure the government into mobilizing budget revenues by aggressively targeting tax evaders rather than over-regulating the legal sector.
