Westchester County, NY Proposes Ban on Deceptive Vapes
Westchester County Executive Ken Jenkins has proposed new legislation to ban the sale of e-cigarettes and vaping products designed to look like everyday items such as pens, highlighters, USB drives, or cartoon characters. The proposed law aims to protect children by eliminating products that can be easily hidden from parents and educators.
“While they may appear harmless, these devices are intended to attract young people and make it easier for them to access nicotine,” Jenkins stated. “This legislation is about protecting our children and keeping Westchester safe and healthy.” He urged the County Board of Legislators to fast-track the bill for quick implementation.
The proposed law would prohibit the sale, offer for sale, or transfer of these deceptive vaping products and establish fines ranging from $300 to $1,500 for violations, with penalties increasing for repeat offenses. The Westchester County Board of Health would be authorized to enforce the law.
The initiative has garnered support from educators and public health advocates. Ossining Schools Superintendent Mary Fox-Alter called the legislation a “critical important protective factor,” noting that hidden devices make it difficult for school staff to see when vaping occurs. Molly Franco of the American Lung Association also voiced support, highlighting that while youth vaping has decreased significantly since 2019, the 2024 National Youth Tobacco Survey still shows over 1.63 million middle and high school students using e-cigarettes, making such protective measures necessary.
