Colombia Proposes Steep Tobacco and Vape Tax Hikes in ‘Economic Rescue Law’
The Colombian government is moving to address a mounting fiscal deficit by restructuring consumption taxes on tobacco and vaping products. Under the proposed “Economic Rescue Law,” the state aims to generate additional revenue to stabilize health insurance funding, explicitly targeting both combustible and electronic alternatives.
The legislative proposal redefines “processed tobacco” to encompass heated tobacco products and expands the tax net to include all electronic nicotine delivery systems (ENDS) and non-nicotine alternatives. This shift ensures that virtually all devices generating aerosol through liquid heating are subject to specific fiscal oversight.

Producers and importers remain the primary parties responsible for the tax, with distributors held jointly liable. The law also mandates that transport companies and retailers verify the origin of their stock, as they will be held directly accountable for moving or selling undocumented products.
Following the 2027 and 2028 implementation phases, the tax rates will move away from fixed legislative updates. Beginning January 1, 2029, taxes will track the national inflation rate plus an additional four percentage points annually. The Ministry of Finance’s Fiscal Support Directorate will be tasked with certifying these adjusted values before the start of each fiscal year.
