Florida Bill Seeks to Ban Public Marijuana Smoking & Vaping
Florida Senator Joe Gruters has filed new legislation, Senate Bill 986, which aims to significantly expand the state’s Clean Indoor Air Act to explicitly prohibit the smoking or vaping of marijuana in public places statewide. The bill seeks to broaden existing laws, which currently target tobacco in enclosed workplaces, to cover marijuana smoke and vapor in a wide range of both indoor and outdoor public areas.
Under the proposal, “public place” would be newly defined to include streets, sidewalks, parks, beaches, and common areas of schools and hospitals. The bill also updates definitions of “smoking” and “vaping” to specifically include marijuana products. Additionally, it would ban marijuana use in airport smoking rooms, even where tobacco might be permitted. Representative Alex Andrade has filed a companion measure, House Bill 389, in the House.
The legislation focuses on regulating public consumption in the interest of public health, without addressing the broader legality of marijuana itself. If approved, the expanded ban would take effect on July 1, 2026.
