New York Conducts Largest-Ever Crackdown on Illegal Vape Sales
New York State has executed what Governor Kathy Hochul is calling the largest criminal vaping enforcement action in its history, resulting in over a dozen arrests and dozens of criminal charges against businesses illegally shipping vape products across the state. The crackdown, dubbed “Operation Vapers’ Dozen,” followed a months-long investigation by the New York State Department of Health and the New York State Police into online vape shops and distribution networks.
“These companies built their business models around breaking New York’s laws and targeting our kids — now, we’re holding them accountable,” Governor Hochul stated. The investigation involved undercover online purchases, which authorities said resulted in the shipment of illicit products designed to appeal to minors. These included brightly colored disposable e-cigarettes and e-liquids in fruit, candy, soda, and dessert flavors, some featuring tech-savvy features like digital display screens similar to smartphones or video games.
New York State law prohibits the retail sale of flavored vapor products, all sales to anyone under 21, and the direct shipment of vape products to consumers and unlicensed businesses. The arrested business owners and operators face charges of Unlawful Shipment and Transport of Vapor Products, a Class A misdemeanor.

- Shinnecock Vape Shop (Long Island)
Representatives from the Shinnecock Vape Shop disputed the charges, citing their sovereign status as a federally recognized nation and their own age verification protocols. However, state officials emphasized that illicit business practices that put products in the hands of underage buyers will not be tolerated in New York.
