Experts Question Poland’s Flavored Nicotine Pouch Ban
The Polish government is preparing to implement a controversial ban on the sale of flavored nicotine pouches and disposable e-cigarettes, aiming to protect youth from addiction. The Ministry of Health cites World Health Organization reports on the harms of these products and their appeal to young people, referencing data showing 22.3% of 12-15-year-olds in Poland use e-cigarettes.
However, experts and industry representatives are skeptical about the effectiveness of this approach. Jakub Bińkowski of the Union of Entrepreneurs and Employers warns that such restrictive policies often fuel the growth of a grey market, potentially introducing unregulated products with even more harmful substances. He argues that the tobacco industry has faced instability with unexpected tax hikes and sudden bans.
Legal experts like Dr. Anna Partyka-Opiela question the proportionality and necessity of the ban, suggesting that better enforcement of existing laws—such as the prohibition on sales to minors—would be more effective. Critics point out that nicotine pouches are primarily used by adult smokers trying to quit and have a lower addictive potential due to slower nicotine absorption compared to cigarettes.
Furthermore, the government has already regulated these products through recent excise taxes and a May 2025 amendment banning sales to under-18s and online distribution. Experts argue that the government should focus on enforcing these existing measures and investing in health education rather than imposing new bans that could have unintended negative consequences.
