Portugal and EU Nations Challenge UK’s Generational Vape Ban
Portugal and six other European Union countries have formally objected to the UK’s proposed generational tobacco and vape ban. They argue that the legislation, which targets anyone born after 2008, violates post-Brexit trade agreements by creating unjustified barriers to the free movement of goods.
Portugal, backed by six other EU member states, has accused the United Kingdom of violating post-Brexit trade laws with its proposed generational tobacco and vape ban. This diplomatic friction arises as the UK advances legislation to prohibit sales to anyone born after 2008, prompting fears of disrupted cross-border commerce.
Alongside Croatia, the Czech Republic, Greece, Italy, Slovakia, and Romania, Portugal has submitted formal observations to Brussels. The coalition contends that the UK bill, which is currently on track for Royal Assent, is fundamentally illegal under current international treaties.
According to Portuguese sources, the legislation directly contravenes the Windsor Framework. This legal mechanism was agreed upon between London and Brussels in 2023 specifically to ease customs controls between the EU and Northern Ireland.
The resistance from these European nations centers on commerce rather than personal freedom or health. They argue the ban would create “unjustified barriers to the free movement of goods” at the borders between the UK and the European single market.
Despite the looming threat of formal talks or a legal dispute between Brussels and London, the UK government remains steadfast. The UK Department of Health insists the legislation is fully compatible with its international obligations regarding Northern Ireland.
The bill, having secured resounding support in the House of Commons, is now scheduled for debate in the House of Lords. Baroness Gillian Merron, parliamentary undersecretary of state, defended the legislation, calling it “the biggest public health intervention in a generation” that will undoubtedly save lives.
