South Africa Advances Strict New Bill Banning Indoor Smoking and Vaping
South Africa’s Parliament has advanced the Tobacco Products and Electronic Delivery Systems Control Bill, signaling a major step toward outlawing indoor smoking and vaping nationwide. Following a committee agreement on June 24, 2026, the legislative push aims to fiercely protect youth while confronting the country’s rampant illicit tobacco trade.
The proposed legislation, which treats electronic delivery systems (vapes) the same as traditional cigarettes, introduces several sweeping reforms to public health policy:
- A complete ban on smoking and vaping in indoor public areas.
- A total prohibition on tobacco and vape advertising, sponsorships, and promotions.
- The removal of all tobacco product displays in retail shops.
- Stricter controls on vending machines and restricted access in areas frequented by children.
Violations under the new law will carry severe penalties, including hefty fines and potential jail time.
While the bill has cleared this initial hurdle, it is not yet finalized. Parliament will now enter detailed, clause-by-clause discussions where amendments are expected. A key point of debate remains whether to regulate vapes differently than combustible cigarettes based on public feedback.
Committee Chairperson Ms. Faith Muthambi emphasized that while “South Africa needs this law,” the current vote is a mandate to refine and improve the text. Future discussions will also address how the rules might impact informal traders and traditional healers, ensuring the final law is both intelligent and balanced.
