Spain Restricts Vape Sales to Specialized Stores to Protect Minors
Spain’s two major political parties, the PSOE and PP, have reached a rare consensus to severely restrict where vaping products can be sold. Approved by a parliamentary commission, this new non-binding resolution aims to strip e-cigarettes and nicotine pouches from general retail and online platforms, directly targeting youth access and a growing illicit market.
Under the new proposal, the sale of vaping devices will be strictly limited to controlled environments, specifically licensed tobacconists and specialized vape stores. This measure is designed to enforce strict age verification and ensure compliance with health, tax, and environmental regulations.
Currently, the widespread availability of vapes in bazaars, supermarkets, and online stores without effective age gates has made it too easy for teenagers to bypass restrictions. Furthermore, the initiative seeks to tackle the booming black market.
Recent European studies highlight a massive influx of unregulated devices, primarily from Asia, that pose significant risks:
- Excessive Nicotine:Â Illegal devices often exceed legally permitted nicotine concentrations.
- Health Risks:Â Many contain undeclared ingredients and lack proper health labeling.
- Tax Evasion:Â These imported products completely bypass national tax systems.
Interestingly, this parliamentary push highlights a policy gap in Spain’s broader draft anti-smoking law. While the Ministry of Health’s draft proposes fining parents of minors caught vaping, it currently lacks measures to control retail points of sale.
Spain’s move reflects growing European concerns over illicit vaping. For instance, France loses over €4.3 billion annually to illicit trade, while the Netherlands reports that nearly 90% of vapers use illegal or unauthorized products. By restricting sales to specialized channels, Spain appears to be leaning toward the models of the UK and New Zealand, which rely on strict point-of-sale oversight rather than outright prohibition.
