Ukraine Bills to Full Ban on Vapes & Nicotine Pouches
The Ukrainian Parliament, the Verkhovna Rada, is currently considering a series of six draft laws aimed at establishing clear rules for new nicotine products, including oral nicotine pouches, sachets, and electronic cigarettes (vapes). These proposals range from setting specific regulatory controls to implementing complete prohibitions on their sale and circulation within Ukraine.
The main bill, No. 14110, proposes a complete ban on the production, import, sale, and any circulation of “nicotine products for oral use,” such as pouches or sachets. This radical approach has drawn criticism from some military members and experts who argue that these products are widely used by Ukrainian soldiers as a smokeless, fire-free nicotine option suitable for field conditions. Opponents of a full ban also warn it could drive the market underground, similar to what reportedly happened with flavored vapes (where an estimated 93% of the market is now in the shadows), leading to significant state budget losses—with around UAH 1 billion in tax revenue expected from these products in 2025 alone.
Another significant proposal, Bill No. 14110-4, introduces a complete ban on the production, import, sale, and advertising of electronic cigarettes (vapes), their liquids, and refill containers.
In contrast, several alternative bills (Nos. 14110-1, 14110-2, 14110-3, 14110-5) aim to legalize and regulate the circulation of nicotine pouches and other tobacco-free products rather than banning them outright. Common provisions across these regulatory proposals include:
- Manufacturer Notification: Requiring manufacturers to notify the Ministry of Health three to six months before introducing products to the market, submitting detailed information on composition, nicotine content, and toxicological data.
- Nicotine Content Limits: Setting a maximum nicotine content, typically around 20 mg per portion (one bill proposes 17 mg).
- Sales and Marketing Restrictions: Prohibiting advertising, sponsorship, and all sales to minors.
- Packaging and Labeling Requirements: Mandating clear packaging with product information (composition, dosage, production date) and a prominent health warning, such as “This product contains nicotine and causes addiction,” covering at least 30% of the package surface.
These legislative efforts reflect a broader push within the Ukrainian government to address the growing market for new nicotine products, which are distinct from traditional tobacco and heated tobacco products like IQOS. The outcome of these debates will determine whether Ukraine pursues a path of strict prohibition or controlled regulation for vapes and nicotine pouches.
