Denver Flavored Nicotine Ban Takes Effect Jan 1, 2026
A comprehensive ban on the sale of flavored nicotine and tobacco products officially took effect in the City and County of Denver on Thursday, January 1, 2026. This measure follows the approval of Referendum 310 by Denver voters in November, impacting approximately 575 retailers across the city who are now prohibited from selling these items.
The ban has had an immediate impact on local businesses. Kristen Hensel, owner of Rusty’s Vape & Smokeshop, described clearing out her Denver store’s vape section on New Year’s Eve as “dismantling my business.” She estimates losing 50% of her revenue, noting that flavored products accounted for roughly $750,000 in sales last year. While Hensel can relocate stock to her Commerce City location outside Denver, she acknowledged that many other shop owners lack this option and face an uncertain future.
Enforcement of the ban begins immediately, led by Denver’s Department of Public Health and Environment (DDPHE). The department will issue fines and suspensions to non-compliant retailers through both routine inspections and undercover operations involving youth operatives. The city aims to ensure strict adherence to the new law, which targets products often cited as appealing to minors.
