Argentina: Bahía Blanca Bans Vaping in Public Spaces and Restricts Sales
The Deliberative Council of Bahía Blanca has passed a municipal ordinance to regulate the use, commercialization, advertising, and distribution of electronic cigarettes. This local measure aims to protect public health and prevent nicotine uptake among youth, establishing clear boundaries for where these devices can be used and how they can be sold.
Under the new rules, vaping is prohibited in healthcare facilities, educational institutions, government offices, and public transport. The ban also extends to social and recreational spaces, including bars, as well as public cultural and sporting events. These restrictions apply to all vaporizing devices, regardless of whether the liquids contain nicotine.
To curb youth access, the ordinance bans the sale, delivery, or free distribution of e-cigarettes and accessories to minors under 18. Retailers are barred from displaying these products on open shelves or accessible racks, and street vending is prohibited. Furthermore, any advertising on public roads, print media, radio, or digital channels accessible to minors is banned.
This local crackdown contrasts with Argentina’s national policy. Under National Resolution 549/2026, the federal government permits the sale of registered vapes, heated tobacco, and nicotine pouches to regulate the market and curb illicit trade. While federal rules focus on manufacturer registration and product traceability, Bahía Blanca has chosen to enforce stricter local consumption and marketing limits.
