FDA Allocates $200M to Combat Illicit Vapes, Boosts Enforcement
As part of a continuing resolution passed by Congress and signed by President Donald Trump on November 12th, the U.S. Food and Drug Administration (FDA) is now mandated to allocate at least $200 million towards enforcing regulations on electronic nicotine delivery systems (ENDS). This funding, drawn from the FDA’s user fees, aims to significantly bolster efforts against illegal vape products, particularly those imported from China and other countries.
Of the allocated amount, $2 million will specifically support a multi-agency task force, including the Justice Department and Homeland Security, focused on cracking down on the influx of illicit ENDS products. This initiative is part of a broader legislative package, the Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations bill for fiscal year 2026, which secured government funding.
The FDA is also required to update its 2020 ENDS enforcement guidance within one year to explicitly include flavored disposable vapes and clarify their definition. Furthermore, the law strengthens the FDA’s authority to regulate the import of tobacco products by updating the Imports and Exports section of the Food, Drug, and Cosmetic Act. The agency must provide semi-annual reports to Congress on its progress in removing illegal ENDS products, with the first report due within 180 days of the law’s enactment.
Officials, including FDA Commissioner Marty Makary, have emphasized the public health and safety concerns posed by these unregulated products, which often arrive disguised as other items. An FDA spokesperson noted the agency’s plan to utilize artificial intelligence to stem the flow of products appealing to children. This crackdown follows significant seizures, such as the $34 million worth of unauthorized vapes intercepted in Chicago in May.
