Kentucky Retailers Rush for Tobacco Licenses Before Jan 1
Kentucky tobacco retailers are in a race against time to comply with a new state licensing law before the January 1st deadline. Senate Bill 100, passed in March, mandates that any establishment selling nicotine, vape, or tobacco products must obtain a license. However, the application portal only opened in mid-November, leaving thousands of businesses with a critically short window to secure approval.
Steve McClain of the Kentucky Retail Federation reported that as of this week, only 1,500 applications have been approved out of an estimated 7,000 retailers statewide. The process has been plagued by technical glitches and confusion over extensive paperwork requirements, which include submitting hundreds of pages of lease documents and store photos to the Kentucky Alcoholic Beverage Control (ABC).
“If a store has not gotten a license, even if their application’s been submitted, they will not be able to sell tobacco products,” McClain warned. This raises significant concerns for businesses fearing a halt in sales if approvals aren’t processed in time.
Local business owner Namir Alsod of Vibez Smoke Shop in Lexington, who successfully obtained his license, described the requirements as unclear but necessary for ensuring product safety. “I had to provide everything… My sources, my store, how my store looks like,” he said, advising others to apply immediately. Governor Andy Beshear has promised to investigate the challenges, stating, “Certainly, businesses should be treated fairly.” Meanwhile, the ABC warns that selling without a license on Jan. 1 could result in fines or criminal charges.
