Luxembourg Passes Stricter Law on Vapes & Nicotine Pouches
Luxembourg has adopted a significant new tobacco control law, Bill No. 8333, which updates its anti-smoking regulations to include modern nicotine products like heated tobacco and oral nicotine pouches. Passed by the Chamber of Deputies on October 31st, the law transposes a European directive while introducing stricter national measures aimed at protecting public health, particularly among youth.
A key aspect of the reform is the regulation of heated tobacco products, which now face a ban on flavorings and are required to display prominent health warnings on their packaging. The law also sets rules for the labeling and marketing of e-cigarettes and nicotine-free liquids, and mandates that vending machines display health warnings and remove promotional graphics.
The major new feature is the strict supervision of nicotine pouches, which were previously unregulated. They are now subject to the same rules as tobacco, including a ban on advertising and sales to minors. Crucially, the law imposes a strict nicotine content limit of 0.048 mg per pouch or per gram, a level that business groups argue amounts to a disguised ban. Additives like caffeine and CBD are also prohibited, and the use of these pouches will be restricted in certain public places frequented by young people.
Reactions are mixed. Health organizations like the Cancer Foundation and the Medical College have welcomed the law as a necessary step, though some believe it doesn’t go far enough. The Medical College also argued for a clearer distinction between consumer products and those used for nicotine cessation. Conversely, the Chamber of Commerce strongly criticized the bill, denouncing it as an over-transposition of EU law (“gold-plating”) that could distort competition with neighboring countries and fuel a black market. They also deplored the lack of a sufficient transition period for businesses. The law is set to take effect on the first day of the month following its official publication.
