Ohio Proposes Vaping Registry and Strict Retailer Licensing
Ohio lawmakers have introduced House Bill 849 to crack down on the state’s largely unchecked vaping market. Driven by concerns over youth addiction and illegal imports, the legislation aims to establish a statewide product directory and implement strict licensing requirements for retailers and distributors.
Sponsored by Republican Reps. Jodi Salvo and Phil Plummer, the legislation is pitched as an “accountability and enforcement bill” rather than an outright ban. Salvo pointed out that while Ohio heavily regulates traditional cigarettes with licensing and compliance checks, the rapidly evolving vapor marketplace currently operates with extremely limited guardrails.
The core mechanism of HB 849 is the creation of a statewide directory. Relying on existing federal pathways, the state will only allow the sale of vaping products that have received or are actively seeking Food and Drug Administration (FDA) authorization. Products failing to meet this standard will be treated as contraband, bringing Ohio in line with roughly 13 other states utilizing similar registry systems.
Rep. Plummer emphasized the severe impact of unregulated vapes in schools, specifically calling out illicit products imported from China that are intentionally designed to attract minors.
To directly combat underage appeal, HB 849 introduces strict prohibitions on marketing and packaging. The bill explicitly bans products featuring:
- Cartoon characters or celebrity imagery.
- Designs mimicking school supplies, smartphones, cosmetics, or toys.
- Built-in entertainment features, such as video games or music players.
Furthermore, the legislation restructures the financial and legal accountability for businesses operating in the vapor market by introducing new licensing fees and criminal penalties for non-compliance.
