Mexico’s Chamber of Deputies to Vote on Vape Ban Next Week
The Health Commission of Mexico’s Chamber of Deputies is scheduled to vote next Tuesday on significant reforms to the General Health Law. These reforms aim to regulate and prohibit the distribution and sale of electronic cigarettes and vapes, alongside various toxic substances and narcotics, including fentanyl and other chemical precursors.
The presidential initiative, originally presented on September 26, proposes a broad definition for prohibited devices. It classifies “electronic cigarettes, vapes, and other similar systems or devices” as any mechanical or electronic apparatus used to heat, vaporize, or atomize toxic substances—with or without nicotine—that are distinct from tobacco and susceptible to inhalation. Notably, the current wording appears to exclude heated tobacco products, a point that Ricardo Monreal Ávila, the coordinator for the ruling Morena party, intends to discuss with commission president Pedro Centeno.
Monreal emphasized a strong stance against industry pressure, stating, “We have no reason to listen to those who poison the country. Even if they are powerful lobbyists or powerful companies in the tobacco industry, we must look out for health.” He stressed the need to avoid any regression in health policy.
The proposed legislation outlines severe penalties for violations. The use and distribution of these electronic devices could result in prison sentences ranging from 1 to 8 years. Additionally, fines could be imposed amounting to 100 to 2,000 times the daily value of the Unit of Measurement and Update (UMA), equivalent to approximately 11,314 to 226,280 pesos.
While the vote in the commission is imminent, Monreal noted that he would reserve his full opinion until the commission’s ruling reaches the plenary session for a comprehensive review. This legislative move is part of a broader agenda that also includes discussions on reducing the work week to 40 hours, a proposal supported by President Claudia Sheinbaum.
