What UK Pub Operators Need to Know About Indoor Vaping Rules in 2026
Following the Royal Assent of the Tobacco and Vapes Act 2026, UK pub operators are navigating a legal grey area regarding indoor e-cigarette use. With 5.4 million vapers in the UK, venues must currently rely on self-enforced house policies while bracing for potential government-mandated indoor bans.
Nick Landells, a legal executive at Poppleston Allen, clarified that unlike combustible cigarettes—which have been banned indoors since 2007—there are currently no legal consequences for allowing vaping inside pubs. However, the new legislation paves the way for tighter restrictions.
The 2026 Act empowers the Secretary of State to ban vaping in any space where smoking is also prohibited. Landells noted that an indoor pub vaping ban is highly foreseeable in the future, though political will to restrict vaping in outdoor beer gardens remains low.
In the absence of nationwide legislation, pub operators are setting their own standards based on customer demographics. Vape clouds and fumes can deter non-smoking patrons, cut visits short, and disrupt family-friendly environments.
Major pub companies have taken a proactive stance. Greene King, JD Wetherspoon, and Fuller’s have all explicitly banned indoor vaping across their managed sites. A Fuller’s spokesperson noted that customers are generally compliant when asked to move to outdoor spaces like beer gardens.
To maintain a welcoming environment and assist staff, legal experts strongly advise operators to implement clear signage detailing their specific vaping rules. Under current UK regulations, pub operators have three primary options for managing e-cigarette use:
- Allow vaping freely throughout the entire venue.
- Restrict vaping to designated areas (e.g., permitted in the main bar, but banned in the dining room).
- Implement a total indoor ban, requiring vapers to step outside.
Ultimately, staff are legally entitled to ask customers to stop vaping if it breaches venue policy. Until further government guidance is published, clear communication remains the best tool for pub operators to manage the UK’s growing vaping population.
