Mexico Enforces Total Ban on All Vaping Products and E-Cigarettes
As of January 16, 2026, Mexico has officially implemented a comprehensive ban on the sale, production, and distribution of all vaping devices and e-cigarettes, regardless of their nicotine content.
- Absolute Prohibition: The ban covers all devices, liquids, and disposables, automatically revoking all previously issued sanitary permits.
- Severe Penalties: Violators now face up to eight years in prison and maximum fines exceeding 234,000 pesos.
- Advertising Ban: All forms of marketing and promotion for vaping products are strictly illegal across all media platforms.
The Mexican government has officially enforced a total nationwide ban on all vaping products and e-cigarettes. Taking effect on January 16, 2026, this sweeping reform to the General Health Law criminalizes the entire commercial chain of vapes to protect public health.
The legislative modification, approved by the Congress of the Union in December 2025, was published in the Official Diary of the Federation, marking its immediate national application.
Under the revised law, it is strictly prohibited to use any electronic or mechanical system designed to heat, vaporize, or atomize substances. This restriction is absolute, applying equally to nicotine-based products and those marketed as nicotine-free.
The new legal framework dismantles the entire commercial supply chain. Prohibited activities now include:
- Production, manufacturing, and mixing of vape liquids, gels, salts, waxes, or oils.
- Importation, exportation, transportation, and storage of devices.
- Sale, distribution, and supply of any vaping hardware, including single-use disposables.
Furthermore, the reform completely outlaws all advertising and propaganda for vapes and e-cigarettes across print, digital, television, and radio platforms to prevent youth targeting.
With the law’s enactment, all prior sanitary authorizations are automatically nullified. The Federal Commission for the Protection against Sanitary Risk (Cofepris) is tasked with notifying businesses to immediately suspend operations.
To enforce this strict health policy, authorities have established severe criminal and financial sanctions for non-compliance.
