Switzerland: Fribourg Proposes Sweeping Ban on Disposable Vapes and Strict Ad Limits
The Council of State in the Swiss canton of Fribourg has launched a consultation on a preliminary draft law aimed at reinforcing youth protection against nicotine addiction. Aligned with the federal LPTab (Tobacco Products Act), the proposal introduces a sweeping ban on the sale, distribution, and manufacturing of disposable vaping devices (“puffs”). It also mandates rigorous test purchases to enforce age limits and imposes stricter advertising restrictions than federal law, targeting public spaces, cinemas, and cultural events.
Targeting the “Puff” Epidemic and Cross-Consumption
The legislative move responds to a rapidly evolving market where traditional tobacco use is slightly declining but being offset by a surge in alternative products like snus, heated tobacco, and disposable vapes. The State Council identifies this dynamic as a critical risk for youth, leading to increased nicotine dependence through “cross-consumption.” By prohibiting single-use devices, the canton aims to curb both the public health impact on minors and the environmental waste generated by lithium-battery disposables.
Strict Advertising and Promotion Limits
The draft law goes beyond federal standards to create a comprehensive shield around youth. Advertising for tobacco, e-cigarettes, and similar products will be strictly forbidden in public domains, private areas visible from the public, cinemas, and during sporting or cultural events. Furthermore, the proposal bans the free distribution of these products as gifts or prizes and outlaws sponsorship deals that encourage consumption.
